Terms of Use for Gralie App

1. Introduction

This User Agreement is a legally binding contract between you and the developer of Gralie, governing your use of the Gralie app and all services provided by the App. Gralie is an AI-powered fashion portrait creation app focused on social sharing, enabling users to upload portraits via camera or photo album, complete basic portrait compliance verification, and generate two types of fashion content with one click: T-stage style vertical portrait photos and 5-second 3:4 vertical runway walk short videos. By downloading, installing, or using the App in any way, you acknowledge that you have read, understood, and agreed to be bound by all the terms and conditions set forth in this Agreement. It is important to note that Gralie does not collect any user facial information and will never share any user personal data with third-party AI services, ensuring your privacy is fully protected during your use of the App.

2. Acceptance of Terms

By accessing or using the App, you confirm that you have reached the legal age of majority in your jurisdiction or have obtained the consent of your parent or legal guardian if you are a minor. If you do not agree to any of the terms and conditions in this Agreement, you must immediately cease downloading, installing, and using the App. The Developer reserves the right to modify or update this Agreement from time to time, and such modifications will be posted within the App. Your continued use of the App after the modifications take effect shall constitute your acceptance of the updated Agreement.

3. App Usage Rights and Restrictions

The Developer grants you a non-exclusive, non-transferable, revocable license to use the App solely for personal, non-commercial purposes in accordance with this Agreement. You agree not to use the App for any illegal, fraudulent, or inappropriate purposes, including but not limited to:

4. User Content and Intellectual Property

All content uploaded by you to the App (including but not limited to portrait photos) and all content generated by the App (including fashion portraits and short videos) are owned by you or the legitimate copyright holder of the original content. By uploading content to the App, you grant the Developer a non-exclusive, worldwide, royalty-free license to use, display, and process such content solely for the purpose of providing the App's services to you. The Developer does not claim any ownership rights to your content, and you retain full control over your content at all times. The App's logo, name, interface design, AI technology, and other intellectual property rights are owned by the Developer, and you shall not use, copy, or distribute such intellectual property without the Developer's prior written consent.

5. Privacy Protection

The Developer attaches great importance to user privacy and is committed to protecting your personal data. The App does not require users to register an account to access basic functions, and all content uploaded by you and generated by the App is stored locally on your device. The Developer does not call, store, or back up any of your content on its backend servers. As previously stated, Gralie does not collect any user facial information and will never share any user personal data with third-party AI services. You have the right to view, edit, or delete your uploaded and generated content at any time through the App's built-in functions.

6. User Responsibilities

You are solely responsible for your use of the App and any content you upload or generate. You confirm that any content you upload does not infringe the copyright, trademark, privacy, or other legitimate rights of any third party. If your use of the App or your content causes damage to the Developer or any third party, you shall bear full legal liability and compensate for all losses incurred. You are also responsible for ensuring the security of your device and your access to the App, and the Developer shall not be liable for any losses caused by unauthorized access to your device or the App.

7. Service Suspension and Termination

The Developer reserves the right to suspend or terminate your access to the App at any time without prior notice if you violate any of the terms and conditions of this Agreement. Upon termination, you must cease all use of the App, and the Developer may delete any content stored locally on your device. The Developer may also suspend or terminate the App's services temporarily or permanently due to technical failures, maintenance, legal requirements, or other reasons beyond its control, and will use reasonable efforts to notify users in advance when possible.

8. Disclaimers

The App is provided on an "as is" and "as available" basis. The Developer does not guarantee that the App will be error-free, uninterrupted, or free of defects. The Developer shall not be liable for any technical issues, service disruptions, or data loss caused by factors beyond its control (such as device malfunctions, network problems, or power outages). The Developer does not endorse any content uploaded or generated by users, and shall not be liable for any damages or legal liabilities arising from such content.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to damages from loss of data, loss of profits, or emotional distress. The Developer's total liability for any direct damages shall not exceed the amount of any fees you have paid to use the App's premium services (if any).

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where the Developer is located, without regard to its conflict of law principles. Any disputes arising out of or in connection with this Agreement shall be resolved through friendly negotiation between you and the Developer. If negotiation fails, either party may initiate legal proceedings in the court with jurisdiction over the Developer's location.
